Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and [Legal entity name, registered address — insert before publishing] ("Bisiq," "we," "us") governing your use of the Bisiq application and related services (the "Service"). This draft is a starting point; have it reviewed by qualified counsel in your operating jurisdiction before publishing. By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use Bisiq. By using the Service, you represent that you meet this requirement and that your use complies with all laws applicable to you.

2. Your account

  • You are responsible for the security of your device, password, and any recovery credentials you set up.
  • Keep your login credentials confidential. You are responsible for activity that occurs under your account.
  • Because Bisiq binds an account to a device at sign-in, signing in on a new device signs the previous one out — treat an unexpected sign-out as a signal to check your account's security.
  • Notify us promptly at support@bisiq.app if you suspect unauthorized access.

3. Acceptable use

You agree not to use the Service to:

  • Violate any applicable law, or the rights of others;
  • Harass, threaten, impersonate, or defraud another user;
  • Send unsolicited bulk messages, spam, or abuse the contact-request or Near Me discovery features;
  • Attempt to reverse-engineer, decompile, or interfere with the Service, its encryption, or its infrastructure, except to the extent such restriction is prohibited by applicable law;
  • Introduce malware, or attempt to gain unauthorized access to any account, system, or network connected to the Service; or
  • Use the Service for any purpose that is illegal in your jurisdiction.

We may suspend or terminate accounts that violate this section, including based on reports from other users (block/report), without needing — and typically without being able — to inspect message content.

4. The nature of the Service — what we can and can't do

Bisiq is architected so that message content is end-to-end encrypted and never readable by us. This means:

  • We cannot moderate, filter, or review the content of your conversations, because we never have access to it.
  • Content moderation relies on you: the in-app block and report tools, and account-level enforcement based on the metadata and reports available to us.
  • Message delivery depends on both devices being reachable within the same general window when peer-to-peer delivery is used; we do not guarantee delivery time, and in some conditions (e.g., both devices offline for an extended period) delivery may be delayed.

You remain solely responsible for the content you send and receive.

5. Subscriptions, tiers, and payments

  • Bisiq offers optional paid account tiers with additional features or limits, described in-app at time of purchase.
  • Payments are processed by our payment partner (currently Midtrans); by purchasing, you also agree to that partner's applicable terms.
  • Prices, features, and available tiers may change; we will show current pricing before you complete a purchase.
  • Refunds are handled on a case-by-case basis in accordance with applicable consumer-protection law and our then-current refund practice — contact support@bisiq.app for a request.
  • Voucher codes, where offered, grant the tier/level described at redemption and are subject to any expiry or one-time-use conditions stated when issued.

6. Third-party services

The Service relies on third-party infrastructure — including connectivity relays (TURN/STUN), push notification providers (Firebase Cloud Messaging, Apple Push Notification service), and our payment processor. These providers operate under their own terms and privacy policies, and we are not responsible for their acts or omissions beyond what is disclosed in our Privacy Policy.

7. Intellectual property

The Bisiq name, logo, and application are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Bisiq app for your personal, non-commercial communication, subject to these Terms. You retain ownership of the content you create; you grant us no license to message content, which we never receive.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT MESSAGE DELIVERY WILL ALWAYS SUCCEED WITHIN ANY PARTICULAR TIME, GIVEN THE PEER-TO-PEER DELIVERY MODEL DESCRIBED IN SECTION 4.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BISIQ AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, MESSAGES, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.

10. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your violation of these Terms or misuse of the Service.

11. Termination

You may stop using the Service and delete your account at any time from Settings. We may suspend or terminate your access if you violate these Terms, or as required by law. Sections that by their nature should survive termination (e.g., §§7–10) will survive.

12. Governing law & disputes

These Terms are governed by the laws of [insert governing jurisdiction, e.g. the Republic of Indonesia], without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved in the courts of [insert venue], unless applicable law requires otherwise.

13. Changes to these Terms

We may update these Terms from time to time. We will update the "Last updated" date above and, for material changes, provide additional notice in-app. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
